Amendments in the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017

The Government of Maharashtra has made changes to the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017.  The Act has been renamed as Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2018.

Here are the other changes that were made:

  1. Introduced the definition of Managerial Functions. Employer to file the list of people discharging managerial functions on an annual basis.

  2. Registration is required in case the establishment is having 10 or more workers

  3. Submission of online application for registration is mandatory

  4. The certificate of registration/renewed certificate/fresh modified certificate of registration (in case of change) will be digitally signed by the Facilitator

  5. Conditions for employment of women workers in the night specified –

    • The employer must ensure the safety of women workers working at night

    • Additional paid holidays to be given

    • Transportation facility must be provided

    • Police verification of all drivers, guards etc. is a must

    • Consent of women workers must be obtained

    • Number of women workers must not be less than 3 at any point

      of time

    • Complaint box facility must be provided in the workplace

    • Display of police/women help line numbers must be provided in the workplace

  6. The company must display a notice on the website and at a conspicuous place in the establishment that shows hours of work, rest interval and weekly holiday

  7. The shift schedule must be displayed on the website and at a conspicuous place in the establishment and a copy should also be sent to the facilitator in the govt. department

  8. Concept of part time workers is introduced

  9. Identify card of the worker must include his emergency contact number

  10. Constitution of Health, safety and Welfare Committee is mandatory in case 100 or more workers are ordinarily employed. Constitution, duties and responsibilities of such committee must be prescribed in the rules also.

  11. Employer to take fire safety measures as prescribed by the Fire officer/Department of Local Authority etc

  12. Employer must adopt all safety measures as suggested in the Fire and Safety Policy which is declared and updated by the Government regularly

  13. Provision of providing the Latrines and Urinal facility by the employer or by the group of employers

  14. The entries in the registers and records may be digitally signed by the employer

  15. Annual Return is required to be filed by uploading the same on the website within 2 months for the year ending 31st December

  16. Procedure of compounding of offences is prescribed

  17. No Shop and Establishment fees on renewal
